How we keep our assessments fair, valid, and California-compliant
Top Notch Finders designs its assessment methodologies — Talent MetaManagement®, the Neural Talent Intelligence System™, and PRISM™ — to comply with California's Fair Employment and Housing Act (FEHA) and the California Civil Rights Council's automated-decision-system regulations (effective October 1, 2025), as well as the California Privacy Protection Agency's automated decisionmaking technology (ADMT) regulations.
Job-related and validity-anchored.
Every capability we assess is tied to observable, job-relevant behavior and anchored to the US Department of Labor's O*NET occupational framework. We assess what the role actually requires — not personality, background, or any protected characteristic.
Human decision-making, always.
Our tools provide decision-support information to qualified consultants and your hiring team. A knowledgeable human reviews every output, has the authority and the role-relevant understanding to act on it, and makes the final recommendation. We do not use any system to make or substantially replace an employment decision on its own.
No discrimination, including unintentional.
Consistent with FEHA, we work to ensure our methods do not discriminate against any protected group — by disparate treatment or disparate impact. We do not use data points that function as proxies for protected characteristics.
Bias testing and documentation.
We conduct and document anti-bias evaluation of our assessment methods and retain assessment-related records consistent with California's four-year retention requirement. Testing results inform corrections to our methods.
Behavioral, not medical.
Our assessments evaluate workplace behaviors and job-relevant capabilities. They are not medical, psychological, or neurological examinations and are not designed to elicit information about any disability. References to "neural" describe our proprietary methodology's design philosophy, not a measurement of brain activity. Reasonable accommodations are available on request.
Privacy and your rights.
Where our processes are covered by the CCPA/ADMT regulations, candidates receive advance notice of how assessment technology is used and information about applicable access, opt-out, and appeal rights. We conduct privacy risk assessments where required.
Honest About Limits.
No assessment predicts an individual's future performance with certainty. We provide rigorous, structured, job-related information to improve decisions — not guarantees.
